Terms of Service

SECTION 1 — DEFINITIONS

"Services": All coaching programs, subscriptions, digital products, analytics, features, App access, and content provided by Glucose Spikes.

"App": Any web or mobile software used to deliver Services, including dashboards, analytics, data uploads, and communication tools.

"Programs": Wellness services offered for a set duration, including 1-week, 1-month, 3-month, 6-month, and 12-month programs.

"Biosensors": Over-the-counter wearable glucose monitoring devices supplied for personal wellness use.

"Client Data": Information voluntarily provided, including biometric, wellness, and account information.

SECTION 2 — ELIGIBILITY & PURPOSE

You must be:

• Age 18 or older
• A resident of the United States (unless specifically approved)
• Participating for personal wellness purposes only

Services focus on behavioral and lifestyle wellness, not medical care.

SECTION 3 — NON-MEDICAL SERVICES; EMERGENCY POLICY

Glucose Spikes does not:

• Diagnose, treat, cure, or prevent disease
• Manage medications
• Provide clinical interpretation of biomarker data
• Offer emergency or urgent care

If you have a medical condition, contact a licensed healthcare provider.

In an emergency, call 911 immediately.

We may pause or deny services if we believe continuing may place your health at risk.

SECTION 4 — BIOSENSORS & HEALTH DATA LIMITATIONS

Some Programs provide over-the-counter biosensors for personal use. You agree:

• You apply the devices yourself
• Data is inherently imperfect and may contain inaccuracies
• We are not liable for adhesive reactions, placements, malfunctions, or data interpretation errors
• We provide interpretive education, not clinical analysis.

SECTION 5 — ACCOUNT CREATION & SECURITY

You must:

• Provide accurate information
• Maintain confidentiality of login credentials
• Immediately report unauthorized access

You are responsible for all activity occurring under your account.

We may suspend or terminate accounts for:

• Security concerns
• False or misleading information
• Behavior that risks safety or violates these Terms

SECTION 6 — SUBSCRIPTIONS, AUTO-RENEWAL & BILLING

Some Programs renew automatically. By enrolling, you authorize recurring charges to your selected payment method until canceled according to Program instructions.

• All fees are in USD
• You must keep billing info up-to-date
• Failed payments may pause access but do not eliminate your payment obligations
• Chargebacks inconsistent with policy will be disputed.

SECTION 7 — PROGRAM ACCESS, INACTIVITY & TERMINATION

• App access is provided only during active Programs
• Inactive accounts 90+ days may be deleted

We may suspend or remove accounts for:

• Non-payment
• Misuse
• Safety concerns
• Abuse of staff or community

No refunds for termination due to misconduct.

SECTION 8 — CANCELLATIONS, MISSED SESSIONS & SHIPPING POLICIES

As further detailed in your Client Services Agreement:

• 24+ hour notice required for coaching rescheduling
• Late cancellations / no-shows are forfeited
• Biosensor shipments are non-refundable once shipped

SECTION 9 — COMMUNICATION CONSENT (SMS, EMAIL, APP NOTIFICATIONS)

By creating an account, you consent to receive:

• Text messages
• Emails
• Push notifications

You may opt out of marketing communications, but operational messages may be required to use Services.

Standard messaging rates may apply.

SECTION 10 — USER CONDUCT & PROHIBITED ACTIVITIES

You agree not to:

• Misrepresent identity or health information
• Interfere with, modify, or reverse engineer the App
• Copy or redistribute Glucose Spikes content
• Harass or threaten staff or other users

Violation may result in immediate access loss, without refund.

SECTION 11 — INTELLECTUAL PROPERTY & LICENSE RESTRICTIONS

All content, code, designs, videos, analytics, and coaching materials are the exclusive property of Glucose Spikes.

License granted:

• Personal use only
• Non-exclusive, revocable
• No resale, reproduction, or distribution

We may revoke access at any time for violations.

SECTION 12 — PRIVACY & DATA CONSENT

We collect and use information as described in our Privacy Policy, incorporated by reference. By using Services, you consent to that policy.

De-identified data may be used for:

• Marketing
• Research
• Education
• Product development

No identifiable data is shared without your explicit written consent.

SECTION 13 — SERVICE INTERRUPTIONS; SOFTWARE LIMITATIONS

We do not guarantee:

• The App will operate continuously or without error
• Availability of any specific feature or Program

We may modify, update, restrict, or discontinue Services at any time.

SECTION 14 — NO GUARANTEE OF RESULTS

Outcomes depend on individual behavior and physiology.

We do not guarantee changes in:

• Glucose values
• Energy levels
• Weight or performance
• Biomarker trends

You are responsible for your own health decisions.

SECTION 15 — ASSUMPTION OF RISK & RELEASE OF LIABILITY

You voluntarily participate and assume all risks.

To the fullest extent allowed by law:

• Our liability is limited to the total fees you paid
• No punitive, special, or consequential damages

You waive claims arising from:

• Device misuse or inaccuracies
• Data interpretation
• Physical, nutrition, or wellness activity participation

SECTION 16 — INDEMNIFICATION

You agree to indemnify and hold harmless Glucose Spikes from claims arising from:

• Misuse of Services
• Privacy violations through your actions
• Breach of these Terms
• Misrepresentation of your health status

SECTION 17 — DISPUTE RESOLUTION & MANDATORY MEDIATION

Before filing a lawsuit:

• Notify us and attempt informal resolution
• Participate in mandatory mediation in San Francisco County, CA

You waive jury trial and class action rights.

SECTION 18 — MODIFICATION OF TERMS

We may update these Terms at any time.

• Updated versions will be posted with a new date.
• Continued use = acceptance of updated Terms.

SECTION 19 — GOVERNING LAW & VENUE

These Terms are governed by:

• Laws of the State of California
• Exclusive venue San Francisco County
